Legal Malpractice

Lawyers can make mistakes that result in monetary harm to their clients.  Yet, claims of legal malpractice require careful preparation to preserve the case for future litigation.  As a plaintiff, generally you need to establish that a lawyer breached the standard of care required of that lawyer in a given community.  You also need to prove that the lawyer’s departure from accepted standards of care caused you damage.  And in certain circumstances, you must prove the “case-within-the-case” element of a legal malpractice claim.  And in addition to those elements, legal malpractice law also offers lawyers many options in defense of the claim and often requires you to support the claim with expert testimony against the lawyer.
